Terms of service

These terms are the agreement between you and us when you use Molby. We've tried to write them in plain English. Please read them, and ask us if anything is unclear.

1. About these terms

Molby is operated by Inchfield Technologies Limited (寸野科技有限公司), a private company limited by shares incorporated in Hong Kong under the Companies Ordinance (Cap. 622), company number 81236339, registered address Unit 704, 7/F, Tower A, New Mandarin Plaza, 14 Science Museum Road, Tsim Sha Tsui, Kowloon, Hong Kong (“we”, “us”).

By joining the waitlist, creating an account or using Molby, you agree to these terms and to our privacy policy. You must be 18 or over. If you use Molby for a business, you confirm you're allowed to accept these terms on its behalf.

Some parts of these terms apply differently if you're a consumer, meaning you use Molby mainly for purposes outside your trade or profession. Nothing in these terms takes away rights you have by law as a consumer.

2. The service

Molby helps you turn an idea into a product. Mo, our assistant, and a crew of AI specialists carry out research, design prototypes, run user tests, build, launch and monitor products, with your decisions at each step (the “Service”).

Molby is in an invite-only beta. Features will change as we learn, some may be limited or unavailable, and we may set daily limits on free use. We'll do our best to keep the Service available and your work safe, but we can't promise it will always be uninterrupted or error-free.

3. Your account

4. Waitlist and founding members

Joining the waitlist doesn't guarantee an invite by a particular date. Reserving a founding-member seat is free and doesn't commit you to pay.

Founding-member seats are limited to 300 and offered in the order they were reserved. The founding offer is the Studio plan for one year at US$290 instead of US$490. When payment opens we'll email you a checkout link; the details shown at checkout, including what happens at renewal, are the ones that apply. If you don't complete checkout within the time stated in that email, the seat may be offered to the next person.

5. Quotes and deliverables

Molby sells deliverables: things you can see, like a research report, a full prototype or a launched web build. Before any paid work starts, we show you a quote that says what you'll get (for example, the number of screens, rounds of changes and testers), roughly how long it will take, and the price.

6. Balance, payments and subscriptions

7. Refunds

8. Who owns what

Your content and your product are yours. You keep all rights to your ideas and everything you give us. The deliverables we make for you, including the code, designs, copy and other materials, belong to you; to the extent we hold any rights in them, we assign those rights to you once the deliverable has been paid for (or, for free deliverables, when it's delivered). You can ask for a copy of your product's code at any time.

What stays ours. Molby itself, Mo and the crew, our brand, and the reusable modules, templates and playbooks we use to build products remain ours. Where they're part of your product, we give you a permanent, worldwide, royalty-free licence to use, change and run them as part of that product, including after you stop using Molby. Open-source components are covered by their own licences.

What you let us do. You give us permission to host, copy, process and display your content only as needed to provide and secure the Service for you, and to share it with the service providers described in our privacy policy. We may use aggregated or de-identified information about how Molby is used to improve it. We won't use your idea or project content to build products for other users.

AI output. Because AI is involved, parts of a deliverable may resemble things made for others, and generic elements can't be exclusive to anyone. Work made under the free plan may carry a small “Made with Molby” mark.

9. Your product and your customers

You're the publisher of your product. That means you're responsible for:

Payments from your customers go directly to your own payment account. We don't take a share of them.

10. Acceptable use

Don't use Molby to make, or to help make, anything that:

Also don't attack or overload the Service, try to get around its limits or security, reverse-engineer it except where the law allows, or collect testers' data without their consent. We may refuse a project, pause work or suspend an account that breaks these rules. Where it's reasonable, we'll tell you why and give you a chance to fix it first.

11. Other platforms

Molby works with services we don't control, such as Apple's App Store, Google Play, Stripe, domain registrars and AI model providers. Their terms apply to your use of them. We'll follow their rules and do our best for you, but we can't control their decisions, such as an app review rejection or an account suspension, or guarantee their availability.

12. Hosting after launch

We host your live product for as long as you have an active Grow or Studio subscription for it (your first month of Grow is included with a web build). If the subscription ends, we'll email you and keep the product online for 30 days, then take it offline. Either way, you can ask for your code and your product's data in a standard format, so you can host it elsewhere.

13. No guarantee of success

Research reports, verdicts, pricing suggestions and weekly recommendations are our best informed judgement, based on the sources we cite. They are not financial, legal or professional advice. We don't guarantee that your product will be approved by an app store, attract users, or make money. Decisions about your product are yours.

14. Liability

We provide the Service with reasonable care and skill. Apart from the promises in these terms, and to the extent the law allows, we provide it “as is” and don't give other warranties.

To the extent the law allows, we aren't liable for indirect or consequential losses, or for loss of profits, revenue, business or data that you could have backed up, and our total liability to you in any 12-month period is limited to the greater of the amount you paid us in that period and US$100.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that can't be limited by law, and nothing affects your statutory rights as a consumer.

If you use Molby for a business, you agree to cover our reasonable costs from third-party claims arising from your product or content, unless the claim is caused by our own work or breach.

15. Ending the agreement

You can stop using Molby and close your account at any time from settings or by emailing us. We may end or suspend your access if you seriously or repeatedly break these terms, if the law requires it, or if we stop offering the Service, in which case we'll give you reasonable notice where we can and refund any prepaid amounts for work not yet done.

When your account closes, you have 30 days to download your projects and code before we delete them, as described in our privacy policy. Sections that by their nature should continue, such as ownership, liability and governing law, survive.

16. Law and disputes

These terms are governed by the laws of the Hong Kong Special Administrative Region. If there's a problem, please email contact@molby.ai first; most things can be sorted out quickly. Otherwise, the courts of Hong Kong have jurisdiction over any dispute.

If you're a consumer living in the EU, the UK or another country with mandatory consumer protections, you keep the protection of those laws, and you can also bring a claim in the courts where you live.
